Agile Velocity, LLC created this Privacy Policy to disclose collection, use and disclosure of personal information by the company, its employees, affiliates, and successors in connection with its websites, applications, software, services, mobile apps, and other properties displaying this policy (collectively, the "Sites").

Users acknowledge the policy and consent to collection, use and sharing of personal information as described, in accordance with applicable agreements including terms of service and End-User License Agreements.
Some customers may engage Agile Velocity as a "processor" under GDPR or "service provider" under US state privacy laws, where collection and sharing may be governed by the customer agreement and their privacy policy.
Personal Information Collected and Received
Agile Velocity may collect information including: user name, password, first and last name, email address, phone number, occupation, and employment information.
Collection points include:
- Customer contact or correspondence
- Website visits and interactions, including cookie information
- Account registration or creation
- User-contributed content, blog comments, surveys, mailing lists
- Purchases
- Error reports and analytics data
- Business service engagements
The company automatically collects device information such as web browser, IP address, time zone, and browsing activity data.
Agile Velocity obtains information from affiliates, organizations with business relationships, social media sites, marketing databases, and third-party services to supplement user-provided data.
The company does not require sensitive information (racial/ethnic origin, political opinions, religious beliefs, union membership, genetic data, biometric data, health data, sexual orientation). If provided without agreement, users are deemed to have given explicit consent. Some jurisdictions requiring affirmative opt-in consent are excepted from this provision.
Third parties such as customers or social networks may collect additional information separately from Agile Velocity.
Use and Disclosure of Personal Information
Agile Velocity may use and disclose personal information to:
- Deliver requested products and services
- Manage customer relationships and provide support
- Perform business analysis about the Sites and user usage
- Communicate via email, postal mail, telephone, and mobile devices about potentially interesting products or services
- Enforce legal rights, terms, conditions, and agreements

The company uses IP addresses to maintain activity logs, diagnose server problems, and administer the website. IP addresses help identify users and gather demographic information.
Registration and contact forms may require or permit users to provide contact information and demographic details. Agile Velocity uses this information to send requested materials, company information, and promotional content from partners, and may contact users for other purposes.
The company will not disclose personal information to third parties except when: directed by users, operating on behalf of customers per their instructions, or after notifying users and providing opt-out opportunities.
Agile Velocity may partner with companies based on customer interests while respecting privacy consistent with policy disclosures.

Other Information
Agile Velocity may collect, use and share non-identifying information from Sites usage or other available sources, provided it does not individually identify users under applicable law. The company retains records including usage logs and click-throughs and may disclose such data to third parties in aggregate or deidentified form.
Where personal information is deidentified under privacy law, Agile Velocity maintains and uses data only in deidentified form, not attempting reidentification unless permitted by law.
The company collects, uses and discloses separate business information including customer prospect data, employee information, vendor employee business contact information, and employment candidate data. Lawful Basis for Processing
Certain jurisdictions require lawful processing basis. Agile Velocity's lawful bases include consent, contract performance necessity, and legitimate interests of the company or third parties, provided such interests don't outweigh user rights and freedoms.
Legitimate interest examples include: complying with applicable law, protecting against security threats, administering business interests including improvements, and addressing customer relationship issues.
US Website Usage Monitoring Consent
Website usage is subject to monitoring by Agile Velocity and service providers. Beyond traditional analytics, the company may monitor usage through precise mouse movement tracking and session replay code insertion. Service providers may make or receive chat and service ticket transcripts. Advertising, marketing, or social media company technology may be utilized to facilitate advertising, marketing, or services.
We use ClickCease, an ad fraud detection service, to protect our advertising campaigns from invalid clicks and fraudulent activity. Session data may be shared with third parties; service providers may collect session or communication aspects without express notification or opt-in consent.
In the United States, agreeing to website terms of use or acknowledging this Privacy Policy constitutes consent to collection, usage and disclosure as described. Users wishing to retract consent and have information deleted should contact privacy-requests@agilevelocity.com.
Data Retention
Agile Velocity retains personal information as long as necessary for fulfilling described purposes, unless restricted by applicable law.
The company identifies purposes before or at collection time. Collection is limited to information needed for identified purposes. Unless users consent or law requires/permits, personal information is used only for collection purposes or other purposes described at that time. Further consent is sought for processing personal information for different, incompatible purposes.
Retention continues only as reasonably necessary for fulfilling collection purposes, including legal, regulatory, tax, accounting or reporting requirements. Longer retention periods apply if complaints exist or litigation prospects appear reasonable.
Retention periods consider: personal data amount, nature and sensitivity, unauthorized use/disclosure risks, processing purpose achievement through alternatives, and legal/regulatory/tax/accounting requirements.
Users may request deletion in some circumstances (see Your Privacy Rights below).
The company may anonymize personal data for research, statistical, or other permitted purposes, retaining it indefinitely without further notice.

Where services are provided through organizations (employers), the organization is service administrator responsible for controlled accounts/services. Direct privacy questions to the administrator; Agile Velocity is not responsible for administrator privacy or security practices.
Agile Velocity will not discriminate against users exercising data protection rights.
For appeal reconsideration under applicable laws providing appeal rights, request appeals within the required timeframe (fifteen days if none specified) using published contact information.
Further assistance regarding rights is available via provided contact information. Exceptions to rights exist; some or all rights may not apply. Where privacy law permits continued maintenance/use for particular purposes despite requests, Agile Velocity reserves the right to utilize personal information for such purposes. Security, safety, fraud prevention, regulatory/legal compliance requirements, or service delivery necessity may limit rights exercise; specific details will be provided in responses.
EU/EEA individuals may lodge complaints with relevant Supervisory Authorities (list available at: http://ec.europa.eu/justice/data-protection/bodies/authorities/index_en.htm). UK individuals may complain to the UK Information Commissioner's Office (www.ico.org.uk).

How We Store and Process Your Information
Agile Velocity processes and stores information in the United States, European Union Member Nations, Canada, or other countries where the company, affiliates, or service providers maintain operations. Information, including personal information, may be transferred across borders and from user countries/jurisdictions to other countries/jurisdictions. EU and other restrictive-law regions are handled per applicable laws.
Agile Velocity may act as Processor or Subprocessor (not Controller) regarding personal information collected for customers. Processing is set by the Controller with potentially additional or different terms. Customers collecting European Economic Area or United Kingdom citizen personal information should contact privacy-requests@agilevelocity.com to request a Data Processing Addendum (DPA).
International Transfer of Personal Information to the United States
Sites may be hosted and operated in the United States under US law. Collected personal information may be stored and processed in the United States. Users accessing Sites outside the US acknowledge personal information transfer to the United States, understanding that US law may not offer equivalent privacy protections as their jurisdiction.
California Privacy Rights and Disclosures
If the California Consumer Privacy Act (CCPA), as amended, applies, see the "Your Privacy Rights" section above.
California residents may request information regarding disclosure of personal information to third parties for their direct marketing under California Civil Code Section 1798.83 by contacting privacy-requests@agilevelocity.com.
California residents under eighteen years old who are registered website or application users may request publicly-posted content or information removal under California Business and Professions Code Section 22581 by emailing privacy-requests@agilevelocity.com with detailed descriptions. Complete removal is not guaranteed; law may prohibit removal in some circumstances.
California residents with established business relationships may opt-out of personal information disclosure to third parties for marketing purposes.
Children's Privacy
Agile Velocity does not knowingly collect information from anyone under thirteen years old. Those under thirteen should use the website only with parent or guardian involvement and should not submit personal information. Upon discovering a person under thirteen has submitted personal information, the company will use commercially reasonable efforts to delete it from all systems.
Global Positioning System
GPS tracking may be required for Agile Velocity products and services to determine user location (latitude/longitude). Permission is requested before precise geolocation tracking. Authorized information is transmitted as necessary for services, potentially to Agile Velocity, service providers (including hosting), and users or clients if needed. Information is used only for services or collection-related purposes or per Privacy Policy.
Security
Agile Velocity uses industry-standard technologies when transferring and receiving consumer data between Agile Velocity and other companies to help ensure security. However, no system guarantees complete personal information security.
Links
Agile Velocity may create links to other websites. Many unassociated or unauthorized sites link to Agile Velocity Sites. The company cannot control these links and is not responsible for third-party site content.

"Cookies" are small browser-stored information pieces on computer hard drives. Agile Velocity uses cookies for session tracking and other functions and may use cookies for interest-specific content delivery.

The company uses Google Analytics for site marketing analysis, using cookies to show how users interact with the site for experience improvement. Google's use and information sharing from Google Analytics visits is restricted by Google Analytics Terms of Use and Google Privacy Policy.

Do Not Track
Agile Velocity does not alter data collection and use practices based on Do Not Track browser signals unless required by applicable law.
Amendments
Agile Velocity may amend this policy anytime. If personal information will be used materially differently from collection-time statements, users will receive email notification and/or a thirty-day site notice. This Privacy Policy may not otherwise be amended except in writing specifically referencing this Privacy Policy and physically signed by both parties.
